Hello,
I always debate every time I deal with rental tanks, the wording in the agreement of purchase and sale to be clear, that the tank is rental, seller agrees to cancel existing rental contract, equipment to stay on the property. Can you suggest proper wording perhaps?

This is a very interesting and useful article for me. Some real estate agents ask me if I do septic or well inspections and I say "No, I believe they should be left to the professionals certified in their respective disciplines. Their are legal and environmental issues well beyond a 'home inspection' that I don't want to get into." Any comments, suggestions or reference sources from you would be greatly appreciated,

The vendor (municipality) is selling land that was not held for personal use so it is not subject to the exemption. It is a commercial activity and the municipality is an HST registrant so the real question is not will the land be subject to HST, but will the HST be included in the purchase price or in addition to. This is something that should be discussed when drafting the Agreement of Purchase and Sale as there will be a clause related to HST in the agreement. You can also contact the Canada Revenue Agency (CRA) at 1-800-959-8287 and they can help you with any HST questions you may have.
